Human Rights and Development: A Legal-Philosophical Perspective

Authors: B.K. Jhinger, Malviya, S.B.

Open Access

This chapter examines the complex relationship between human rights and development from a legal-philosophical perspective. It aims to: 1. Analyze how human rights principles influence development policies and practices. 2. Explore key international legal instruments and normative frameworks that integrate human rights into development agendas. 3. Engage with philosophical debates on rights, justice, and ethical foundations of development. 4. Propose a ‘Rights-Centric Development’ framework that combines legal enforceability with philosophical legitimacy. The chapter argues for reconceptualizing development as a normative project tied to human dignity, freedom, and justice, rather than just economic growth. It seeks to provide a nuanced understanding of how this perspective can guide inclusive, participatory, and sustainable development practices.
